Short Term Rental Agreement
PALMASBNB Hospitalidade e Serviços Ltda, a company duly registered with the CNPJ/MF under No. 46.555.969/0001-20, Av. Leoberto Leal, 790 , Sala 101A, 88117-000 São José , SC , hereinafter referred to as LESSOR, in the use of the rights granted by the owner of the property object of this lease;
And, in the capacity of LESSEE, the following general clauses and general conditions are contracted and contracted:
Considering that the LESSOR has a power of attorney granted by the owner of the property object of this contract for advising, managing and intermediating seasonal leases;
Considering that the LESSEE chose, of its own free will, to lease a property for a season whose management is the responsibility of the LESSOR, the parties establish the lease agreement in the form outlined below, which must be interpreted and integrated by the general conditions of contract.
FIRST - PROPERTY CONDITIONS
The property that is the object of the lease is the property described in the advertisement published through the LESSOR's services, and all the characteristics of the property are unequivocally known to the LESSEE, who declares to receive in excellent conditions of hygiene, cleanliness and functioning of the hydraulic, sanitary and electrical and all accessories incorporated into the property, such as: flooring, windows, doors, latches, handles, locks, window panes, etc. lease without the right to indemnification or retention of the property for any improvement, even if necessary.
The keys to the property will be delivered in the manner indicated by the LESSOR.
The LESSEE is not allowed to make changes or renovations to the premises of the contracted property.
SECOND - PURPOSE OF THE LEASE
The leased property is exclusively intended for TEMPORARY RESIDENTIAL use, and the LESSOR is prohibited from assigning or lending it in whole or in part, in any capacity. Any tolerance of the LESSOR will not imply tacit consent.
FAMILY parties and gatherings are permitted, with the maximum audience not exceeding 1.5 times the maximum capacity of the property. (Example: if the maximum capacity is 10 people, the maximum audience for the party/family gathering will be 15 people)
Commercial parties with loud, live music or large numbers of guests are STRICTLY forbidden. Smoking is also FORBIDDEN inside the property and in the communal areas of the condominium.
Also, it is not allowed to make any installations, adaptations, improvements or works without the express authorization of the LESSOR. These, once allowed and executed, will immediately adhere to the property, and the LESSEE will not be entitled to any indemnity;
THIRD - LEASE TERM AND VALUE
The term and value of the lease, and the security deposit (if applicable), are those provided for in the terms of the contract, whose options were selected by the LESSEE according to its exclusive needs, without any interference by the LESSOR, the LESSEE being aware of the penalties imposed in case of non-payment, as well as non-delivery of the keys on the date and time indicated by him.
If the LESSEE opts for cleaning services, or other facilities, such services will be charged at the amounts indicated by the LESSOR.
FOURTH - PROPERTY CONSERVATION
The LESSEE undertakes to take care of the property, not exempting itself from the efforts necessary to maintain the integrity of the property. The damage caused to the property or its furniture, equipment and utensils will be covered by the security deposit (if any) given by the LESSEE to cover such expenses. In the event that the security deposit cannot cover these expenses, the LESSOR, or the owner of the property, will make a judicial or extrajudicial collection of such amount. In the event that there is no security deposit, the LESSEE will be charged for the amount and, in the case of refusal to pay, will be sued in court or extrajudicially.
THURSDAY - PAYMENT
Payment will be made in the manner indicated by the LESSEE when choosing the property object of this lease. If the LESSEE chooses to pay by pix or bank transfer, he/she must send the receipt to whatsapp 0055 48 991 334 904 and to the eMail contato@palmasbnb.com.br to validate the reservation.
The LESSOR is not responsible for any failures in the collection made by the credit card companies.
If the LESSEE initiates a procedure of not knowing the purchase with its credit card company, the LESSOR reserves the right to cancel the lease, if it has not been initiated.
FRIDAY - DISCLAIMER
The Lessor will not be responsible for objects or utensils left or placed by the Lessee inside the leased property.
SEVENTH - DELIVERY OF KEYS
The delivery of keys, both at the beginning and at the end of this Agreement, must be carried out in the manner indicated in the general conditions of contract and in accordance with the options available for the property now leased.
EIGHT - FINES AND PENALTIES
Any debt resulting from this agreement will be charged a fine of 10% (ten percent), interest of 1% (one percent) per month and an additional 20% (twenty percent) as attorney's fees, regardless of the filing of the action;
NINTH - COMMUNICATIONS
Any and all contact regarding this lease must be made through the LESSOR's service channels indicated in the general contracting conditions.
TENTH - CONVENTION AND INTERNAL REGULATION
The LESSEE will respect the rules contained in the Convention and in the Internal Regulations of the Building and/or condominium (if any). In the event of non-compliance with such rules, the Lessee will be subject to the legal penalties provided for and, in case of imposition of a fine on the owner of the property, the LESSEE must comply with it within 5 (five) days, counted from the notification for such goal.
